Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and WebeWitch Technologies Pvt. Ltd. ("Company," "we," "us," or "our") concerning your access to and use of the webewitch.com website and our services.
By accessing or using our website and services, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the website or use our services.

User Accounts and Registration
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring your account information remains accurate and up-to-date
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
Intellectual Property Rights
Our Intellectual Property
The website and its original content, features, and functionality are owned by WebeWitch Technologies Pvt. Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Client Work Product
Upon full payment, clients receive ownership of custom work products developed specifically for them. However, WebeWitch retains:
- Rights to reusable code libraries and frameworks
- Pre-existing intellectual property
- Rights to display work in portfolio (unless confidentiality agreement specifies otherwise)
- Rights to methodologies and processes
Service-Specific Terms
Project Scope and Changes
Project scope, timeline, and costs are defined in individual Service Agreements. Changes to scope may result in adjusted timelines and costs. All changes must be approved in writing by both parties.
Payment Terms
Unless otherwise specified in your Service Agreement:
- Payment terms are Net 30 days from invoice date
- Projects may require upfront deposits (typically 30-50%)
- Late payments may incur interest charges of 1.5% per month
- We reserve the right to suspend services for non-payment
Project Timelines
We commit to delivering projects within agreed timelines, subject to timely client feedback and approvals. Delays caused by client-side factors may result in adjusted delivery dates.
Warranties and Disclaimers
Our Warranties
- We warrant that services will be performed in a professional manner
- We provide warranty period for bug fixes (typically 30-90 days post-launch)
- We comply with agreed-upon technical specifications
Disclaimer
Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that services will be uninterrupted, error-free, or completely secure.
Limitation of Liability
To the maximum extent permitted by law, WebeWitch Technologies Pvt. Ltd. shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from third-party services or integrations
- Damages exceeding the amount paid by client in the 12 months preceding the claim
Confidentiality
Both parties agree to maintain confidentiality of proprietary information disclosed during the course of engagement. This includes:
- Business strategies and plans
- Technical specifications and source code
- Customer data and business information
- Financial information
- Any information marked as "Confidential"
Confidentiality obligations survive termination of the agreement for a period of 3 years.
Termination
Either party may terminate services:
- For Convenience: With 30 days written notice
- For Cause: Immediately upon material breach by the other party
- For Non-Payment: After 15 days of payment default
Upon termination, client remains liable for payment of all services rendered up to the termination date.
Indemnification
You agree to indemnify and hold WebeWitch Technologies Pvt. Ltd. harmless from any claims, damages, losses, or expenses (including attorney fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. The courts of Ahmedabad, Gujarat shall have exclusive jurisdiction over any disputes arising from these Terms.
Before initiating legal proceedings, parties agree to attempt resolution through good faith negotiation or mediation.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or website notice. Continued use of services after changes constitutes acceptance of modified Terms.
